Terms and Conditions of Titan decko USA

These Terms and Conditions (hereinafter, the “Terms”) govern the use of the website and services offered by NORTHEM GROUP USA LLC (hereinafter, the “Company”) through its home products eCommerce platform (hereinafter, the “Platform”). By using the Platform, you (hereinafter, the “User”) agree to comply with and be bound by these Terms.

Scope

These Terms apply to all sales of home products (hereinafter, the “Products”) made through the Platform to Users located within the United States, in compliance with all applicable federal and state consumer protection laws and regulations.

Registration

To purchase Products through the Platform, the User must register and provide personal information, including but not limited to their full name, email address, phone number, and shipping address. The User warrants that all information provided is accurate and up-to-date and agrees to keep it current at all times. The Company will protect the User’s personal information in accordance with the Platform’s Privacy Policy.

Order Process

By placing an order through the Platform, the User confirms their intention to purchase the selected Products and agrees to pay the total price, including applicable taxes and shipping costs. The Company will confirm the receipt of the order by email and proceed to process and ship the order once payment has been authorized, subject to product availability and in compliance with the User’s legal consumer rights.

Pricing and Payment

Product prices are displayed in United States Dollars (USD) and include applicable taxes. Shipping costs will be calculated and displayed during the checkout process before the User confirms the order. The Company reserves the right to modify prices and shipping costs at any time without prior notice, provided that such changes do not affect orders already confirmed.

The Platform uses Stripe payment processing service for electronic transactions. The User must provide their credit or debit card details, or another payment method accepted by Stripe, and authorize the charge corresponding to the total price of the order. The Company does not store or have direct access to the User’s payment data and will comply with all applicable data protection laws and regulations.

Shipping and Delivery

The Company undertakes to ship the purchased Products to the shipping address provided by the User within the timeframe indicated during the checkout process, subject to force majeure events and other circumstances beyond the Company’s reasonable control. Delivery times are approximate and may vary due to unforeseen circumstances. The Company is not liable for delivery delays due to causes beyond its reasonable control but will comply with all applicable federal and state laws and regulations regarding consumer rights and timely delivery.

Returns and Refunds

The User has the right to return the Products purchased through the Platform within 30 days from the delivery date, provided that the Products are in their original, unused condition with all tags and packaging intact. To initiate a return, the User must contact the Company’s customer service, who will provide appropriate instructions.

Once the Company receives and verifies the returned Products, a refund will be issued to the original payment method within a reasonable time, in accordance with applicable federal and state consumer protection laws and regulations.

Limitation of Liability

To the fullest extent permitted by law, the Company’s liability for any claims arising from the User’s use of the Platform or purchase of Products shall be limited to the purchase price of the Products in question. The Company shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to lost profits, data, or goodwill, even if the Company has been advised of the possibility of such damages.

Intellectual Property

All content on the Platform, including but not limited to text, images, logos, and designs, is the property of the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws. The User may not reproduce, distribute, modify, or create derivative works from the content on the Platform without the express written consent of the Company or the respective copyright owner.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which the Company is incorporated, without regard to conflict of law provisions. Any disputes arising out of or in connection with these Terms or the use of the Platform shall be resolved through good-faith negotiations between the parties. If the parties fail to reach an amicable resolution, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, and the arbitration shall take place in the state where the Company is incorporated.

Changes to Terms

The Company reserves the right to modify these Terms at any time without prior notice. The User’s continued use of the Platform after any changes to the Terms have been posted constitutes acceptance of those changes. It is the User’s responsibility to review the Terms regularly to stay informed about any updates.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and the Company’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms, along with any other policies or agreements referenced herein, constitute the entire agreement between the User and the Company concerning the use of the Platform and the purchase of Products and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the User and the Company with respect to such matters.
